# Allahabad HC Examines POSH Case Arising From Marital Discord

The Allahabad High Court has stayed disciplinary proceedings against a man accused by his wife, a colleague, under the POSH Act, while examining whether a dispute rooted in marital discord can be treated under the workplace sexual harassment law. Justice Pankaj Bhatia said the legislation was “intended for a different purpose”. The couple married in March 2023 and worked in the same office. The woman alleged that her husband used foul language and made derogatory remarks against her on October 9, 2024. A POSH committee found that their marital discord predated the incident and recommended action against him, as well as both spouses for not disclosing their marriage. The court has sought the respondents’ reply before taking the matter forward.
