The Calcutta High Court has ruled that members of the West Bengal Medical Education Services cannot seek voluntary retirement under state service rules. A division bench dismissed Dr Sanjoy Bhattacharya's petition against the rejection of his 2020 voluntary retirement application. The court said Rule 75(aaaa) of the West Bengal Service Rules, added in 2014, explicitly excludes medical education service members from voluntary retirement. It rejected the argument that another rule independently grants this right, noting the provision only allows the government to relax the restriction on genuine grounds.
