Justice Ajay Mohan Goel remarked that continued retention would not have been possible without the officials being 'hand in glove' with the petitioner. The doctor was allotted the accommodation in July 2016, transferred to Shimla in 2017, but stayed on. Authorities later demanded Rs 12,90,959 in damage charges. The court held the accommodation was not common pool and the retention was unauthorised.
