A bench of Justices Ahsanuddin Amanullah and R Mahadevan called the contrary interpretation by some states "a deliberate and mala fide bogey", warning that non-compliance would lead to contempt notices against chief secretaries and DGPs. The court found states and UTs that failed to file affidavits after its May 22 order to be prima facie in contempt. It ordered personal appearance of Ladakh's chief secretary and DGP for no response. The case originated from a 2011 missing child complaint in Chennai.
