US President Donald Trump signed two executive orders on August 6 seeking to restrict birthright citizenship, weeks after the Supreme Court rejected his earlier attempt. One order targets commercial “birth tourism” through tighter visa measures. The other lists categories whose children, the administration argues, should not receive citizenship documents, including children of foreign government employees, people classified as alien enemies, members of terrorist groups and parents involved in alleged fraudulent transactions. The Fourteenth Amendment has long been understood to grant citizenship to nearly everyone born in the US. The American Civil Liberties Union and immigration lawyer Cyrus Mehta called the new orders unconstitutional, saying an executive order cannot alter the amendment. The Migration Policy Institute estimates 22,000 to 26,000 birth-tourism births annually, while government data recorded 9,600 births to mothers with foreign addresses in 2024.
