Supreme Court refuses to quash CBI case against former NSE CEO Chitra Ramkrishna

The Supreme Court on Tuesday declined to interfere with the Delhi High Court's dismissal of former NSE CEO Chitra Ramkrishna's plea challenging her prosecution under the Prevention of Corruption Act. A bench of Justices JB Pardiwala and K Vinod Chandran refused to quash the CBI case against her, leaving the trial court to decide whether she qualifies as a 'public servant'.

Ramkrishna argued the NSE is a private company, but the court said this point can be raised during trial. The High Court had ruled in July that the NSE performs a public duty and she cannot be separated from those functions. The CBI chargesheet alleges she conspired with former employee Anand Subramanian to grant preferential access to certain brokers and abused her position in appointments and server access.
